A three-judge panel of the federal 5th Circuit Court of Appeals heard arguments on Judge Janis Jack’s ruling that found Texas’ child protection system unconstitutional for children in long term care.
Judge Jack issued a ruling in December 2015 that found that children in Permanent Managing Conservatorship (PMC) were subject to an unreasonable risk of harm. Judge Jack subsequently issued an interim order that included a large number of remedies recommended by her appointed special masters.
