Information Regarding Class C Citations/Tickets Received While in Foster Care or Extended Foster Care

The Law: Article 45.041(b-6), Texas Code of Criminal Procedure, states that a judge in a municipal court or justice of the peace court may not require a defendant who is in foster care or extended foster care to pay any amount of the fine and costs imposed in a case involving a Class C misdemeanor. Instead, the judge may require the defendant to perform community service. This resource from the Texas Foster Youth Justice Project will help CASA volunteers better understand how to help youth navigate this process to make sure they are not liable for municipal fines incurred during their time in foster care.
